Terms of Service

This agreement is between Advanced Trade Solutions, LLC aka(ATS, ArkansasSupport.com, we, us, our) and the customer or client (you).

Obtaining the services of ATS binds you to this service agreement. This agreement may change at any time without notification. All changes apply to new customers/clients as well as existing ones. The laws governing this agreement shall be done so in Saline County, Arkansas.

Free Analysis/Diagnostics
Free Analysis/Diagnostics is limited to Remote Technical Support, Phone Support, and drop-off services. Free Analysis/Diagnostics not valid with in-home, on-site, or pickup and delivery services.

Free Pickup/Delivery
Free Pickup/Delivery is limited to the following cities in Arkansas: Alexander, Benton, Bryant, Mablevale, Otter Creek, Salem, Sardus, and Shannon Hills. An analysis/diagnostic fee will apply to all pc's. After we analize and/or diagnose your computer, we will offer a solution. If you choose to proceed with the solution, the fee will be waived. If you choose to not accept the offered solution, a $55.00 Analysis/Diagnostic fee will be required at the time of pickup or delivery. Free pickup/delivery does not apply to parts only orders.

Pickup/Delivery
We offer pickup and delivery services to all cities in Central Arkansas. Free Pickup/Delivery is limited to the cities stated in this agreement under Free Pickup/Delivery. A pickup/deilivery fee will apply to all other cities in Central Arkansas. Call for current pricing.

Remote Technical Support
ArkansasSupport.com a website owned and operated by Advanced Trade Solutions, LLC. All services offered are preformed under the Advanced Trade Solutions, LLC company. All credit card charges will reflect Advanced Trade Solutions, LLC as the merchant. You agree to pay the appropriate charge for service time rendered by ArkansasSupport.com. If you have a discrepancy in charges, you agree to contact ArkansasSupport.com first for resolution.

You agree to hold ArkansasSupport.com harmless for any complications resulting directly or indirectly from or during the support attempt.

You agree to dedicate the time necessary to allow ArkansasSupport.com to diagnose and solve your computer issue. Premature disconnection of the remote session by the customer (you) will not justify a dismissal of charges. You furthermore agree that you are the owner or authorized user of the credit card you provide for payment of services.

Remote Technical Support is billed at $85.00 per hour.

Customer (you) will be required to supply a valid credit card after the free analyzation or optimization period. An authorization charge of $70.00 will be placed on the credit card. If no service is rendered or solution offered, the authorization charge will be voided. Otherwise the appropriate payment for time rendered will be charged.

First time free offer is for a limited time and includes up to 30 minutes of problem analyzation at no charge. Offer may not include actual correction of issue. Offer may include optimization of your Windows operating system to increase performance and/or analyzation of the problem you are having. A credit card is not required until free analyzation or optimization time has elapsed and you wish to continue support.

Website Development
Advanced Trade Solutions will not knowingly post any material to your web site if it is believed to be in violation to copyright laws.

You agree that any material given to Advanced Trade Solutions such as text, photos, graphics, etc., for the purpose of web site content is of your own original creations or that you have received permission to use such materials. You therefore agree to accept FULL responsibility for any material you give to Advanced Trade Solutions if copyright laws are broken.

Any photos taken and/or produced by Advanced Trade Solutions remain the property of Advanced Trade Solutions. The granting of change of ownership of photos will be determined at the time of the request by the customer. Photos cannot be reproduced or copied without written permission from Advanced Trade Solutions.

Templates within this site are non-exclusive to the customer. Template design will remain the property of Advanced Trade Solutions and under no circumstance will a change of ownership of template designs be granted. You understand you may not copy or re-distribute your web site template without written permission from Advanced Trade Solutions. Furthermore, template designs, specifically chosen by the customer, must remain hosted on our server. Cancellation of hosting will result in repossession of your chosen web site template. All chosen templates are leased on a yearly basis unless otherwise stated by Advanced Trade Solutions. You also understand that your chosen template, being non-exclusive, may also be chosen by another customer of Advanced Trade Solutions under the terms of this agreement.

On any web site that requires custom programming in a web language or DBMS such as php or MySql, etc., the programming portion of the web site remains the property of Advanced Trade Solutions. Under no circumstance will the ownership of custom programming be granted a change in ownership. Custom programming cannot be reproduced or copied without written permission from Advanced Trade Solutions. Ownership of custom programming is not included in the price of the web site design, unless otherwise agreed, and may be revoked from the web site at the discretion of Advanced Trade Solutions.

On any website requiring custom programming, we offer no warranty or guarantee of any kind. However, in most cases, we will help correct any programming problems provided that your website is hosted through Advanced Trade Solutions and you are a current active client.

You agree to pay a 1/3 deposit on all work at the beginning of the service design unless other arraingments are made. This deposit is non-refundable. All costs for any service may be changed at anytime at the discretion of Advanced Trade Solutions. If you are in a written contract with Advanced Trade Solutions, price changes will take effect upon completion of your current contract. Furthermore, any payments you make on your design, before it is completed, will be considered as a non-refundable deposit.

Advanced Trade Solutions does not offer a satisfaction guarantee on website design. Website design skills will be displayed or explained at the beginning of the design. Advanced Trade Solutions will provide a fully working demo of your web site under a sub-domain of our choice to allow you to view the work and content unless, under certain circumstances, the web site will need to be posted to the domain of choice for testing. Advanced Trade Solutions will request permission from the client to post the web site to the chosen domain if testing is needed. Furthermore, the terms of this agreement and the terms of any written contract will still apply. If after the initial design you are not satisfied with your web site, you agree to make clear to Advanced Trade Solutions your specific requirements for guaranteed satisfaction within 10 days of the web site's completion date determined by ATS. This includes clear instructions on graphic design, content, layout, color, functionability and overall development. Additional charges may apply depending on any extra work to be performed. Once a website is published live, it is considered complete.

Website Bundle Promotion $400 down/$40 per month

Unless otherwise stated, the Website Bundle Promotion is a no contract service. This is a website lease that includes several bundled services. Any party, ATS or the Customer, may cancel service at any time. No refunds will be given. Upon service termination, all data remains the property of ATS. Customer may not use any content outside the service or written permission of ATS. The complete design process is at the discretion of ATS. Including but not limited to design principles, photos, video, and all other content, Search Engine Optimization techniques, reporting, etc. You are aware of and agree that your website may be showcased in a portfolio or used in advertisements by ATS. There is no guarantee with this service.

Due to changes in search engine ratings and bookmarked pages, Advanced Trade Solutions will not be responsible for any lost revenues as a result of posting a new or updated web site.

All invoice's are due upon receipt. A grace period of Net-30 days will apply to the first invoice. If full payment is not received within 30 days for any invoice, a new invoice will be mailed or faxed to the customer and a re-printed invoice handling fee of $35.00 may be applied to the outstanding balance. If full payment of any invoice is not received within 30 days of the initial invoice date, Advanced Trade Solutions reserves the right to confiscate the entire web site until full payment is received for all invoices regardless of whether the past due invoice is for a new web site or for a web site update. Furthermore, if your website is confiscated, all due invoices will be considered past due. Advanced Trade Solutions retains the full copyright and ownership of a web site until full payment is received for all invoices, at which time copyright rights and site ownership shall be determined by the preceding content within this agreement. Handling fees are based per month per invoice. (For example, if you have a 3 invoice payment arrangement with Advanced Trade Solutions and you fail to pay the full amount of your first invoice within thirty days of its print date, a handling fee of $35.00 will be applied to the outstanding balance each month until full payment is received for the invoice. If you fail to pay the total due for the first and second invoice by their respective due dates, a handling fee of $35.00 will be applied per month to the outstanding balance for both the first and the second invoice. If you fail to pay the total due for the first, second and third invoices by their respective due dates, a handling fee of $35.00 will be applied per month to the outstanding balance for the first, second, and third invoices.) All payments made are applied to invoices in consecutive order in order to eliminate their respective handling fees. Furthermore, any payments received are first applied to any due handling fees and the remainder, if any, is applied to the outstanding balance of invoices. If any invoice reaches a past due date of 30 days, Advanced Trade Solutions reserves the right to begin collection procedures, including but not limited to, phone calls, letters, and court filing. If your website is confiscated and you are in a collection period, all handling fees remain in effect for the total number of invoices due and will only cease once full payment is received for any outstanding balance. Furthermore, if your website is confiscated or restricted, under no circumstance will hosting fees be refunded. It will be at the discretion of Advanced Trade Solutions to continue hosting services and/or website updating to your site. In either case, refunds will not be given for hosting and we reserve the right to refuse further business services, including but not limited to website updates and website hosting. If full payment is not received for all invoices within 30 days of site suspension or confiscation, we reserve the right to sell your website including graphics, images, content, and domain names in effort to recover the delinquent charges. At time of sale, copyrights shall be transferred from Advanced Trade Solutions, LLC to the purchaser.

For service invoices, all invoices are Net-30 days. We will in no way provide further service until full payment is received for any past due invoice unless other terms have been negotiated and agreed to.

You will hold us harmless for any loss of business or inconvenience resulting from your website confiscation or restriction.

If your website is removed from our server or if access is restricted, once full payment is made for all invoices, a $75.00 fee will be charged for re-posting your website on our server or for un-restricting access or for supplying your website on a CD. This fee must be paid before your site is restored or before a CD is supplied.

You agree to pay the quote given within the written service agreement, if one applies, within 30 days of the web site's posting to the domain name unless other arrangements have been made between you and Advanced Trade Solutions. You furthermore agree to pay any collection fees required by Advanced Trade Solutions to collect payment for services performed. Collection fees include but are not limited to attorney fees, cost for stationary and stamps, long distance telephone charges, and court costs. You are also responsible for paying Advanced Trade Solutions the current billing rate of $85.00 per hour for all collection attempt time spent by Advanced Trade Solutions for any collection issue.

To avoid penalties, simply pay for services provided as initially arranged between you and Advanced Trade Solutions.

Advanced Trade Solutions is in the business of designing websites, offering networking services, technical support, computer repair, and data services. We are not in the business of small business consultation. Although we may offer advice on the operation of a small business, you listen at your own risk. We are not responsible for actions taken based on our advice or consultation.

All work preformed is offered AS-IS. No warranty is offered for any service. You will not hold Advanced Trade Solutions responsible for liability for loss of business or revenue due to including but not limited to data loss, hosting server down times, search engine ratings, program bugs and security issues. Furthermore, computer repair services are offered as-is. For computer repair services where the device is under warranty and requiring shipment, you agree to hold us harmless for damage during shipment.

Computer Repair
Estimated Completion Time: ATS (Advanced Trade Solutions, LLC, ArkansasSupport.com, repair shop) will provide an estimated completion time for your repair/install. Please call before you come in to pick up your equipment. Unforeseen circumstances may have an impact on our ability to complete the repair(s) as provided in the estimate.

Bench Charge: There is a $55 charge for computer diagnostics and analysis unless otherwise stated by the repair shop. If a solution is provided, the bench charge will be waived.

Hardware Replacement: Any old parts/hardware will be returned to you when you pick up your computer.
Impact of Upgrades: Please be advised that it is your responsibility to understand the impact of upgrades to the operating system, applications and utility software. Such upgrades can lead to incompatibilities and the possible loss of data. Computer hardware and software work together and incompatibility may not become apparent until a later date. You are responsible for contacting the manufacturer of your software regarding compatibility issues before you request any upgrades.

Liability: ATS’s liability for damage to your computer is limited only to any damage which is determined to be caused by the ATS’s negligent acts or negligent omissions. Our liability for repairs is limited to the total price of the repairs. Be aware that certain repairs, including but not limited to virus and spyware removal, may damage software, hardware and/or data installed on your computer. This is to be expected and may require the re-installation of your operating system, programs, and data which can be done by you but may not be included in the repair or service process.

Operating System Install/Reinstall: This service erases EVERYTHING from your computer including photos and other data, programs, and settings. It is your responsibility to restore your data, programs, and all other applications and settings from your backup or other media. It is your responsibility to request the repair shop to back up your data prior to this service. Data Backup services are available for an additional fee and are subject to these terms.

Loss of Data: Data is the most important part of a computer system because it is often irreplaceable. Due to the process of repair, data may get damaged or at worst, deleted. ATS is not responsible for the loss of data which may occur while performing work on your computer. You are responsible for backing up your own data. You may request that the repair shop back up your data for you at the stated price; however, we do not guarantee the success of any backup or data transfer.

Ownership: You must own the computer that you bring in for repair(s). ATS will return the computer only to its owner when the repair(s) are complete. You must own and demonstrate ownership of any software that is to be installed or re-installed on your computer by ATS by bringing in the original software CDs and the appropriate keys and/or serial numbers.

Privacy: Our Technicians will not browse through your hard drive looking at your data; however, they may inadvertently see data during the course of their work. Please remove any personal or private files you do not want others to see. When opening or replying to a support ticket, information you provide is recorded and kept in a database. Other information such as the date and time of your post along with your IP address will be recorded. We reserve the right to use this information as we wish.

Right to Refuse: In its sole discretion, ATS reserves the right to refuse work that it believes is beyond the scope of its ability or for any other cause.

Abandonment: If you do not pick up your equipment within thirty (30) days after we notify you that the requested service is complete, we will treat your equipment as abandoned. You agree to hold ATS harmless for any damage or claim for the abandoned property. Any and all charges are still your responsibility.

Scope of Work: ATS will only perform the work agreed upon when you bring your computer in for repair. You must authorize any additional work which may be required.

Warranty: ATS does not warrant its work. We will demonstrate that the repair is complete at the time you pick up your computer.

In-Home/On-Site Service: Minimum of 1 hour at current rate of $85.00. Payment is required at the time of service.

Payment - We accept cash, credit card via Paypal, and local checks. There is a $35 fee for returned checks. Any service provided by ATS may be suspended or revoked at the sole discression of ATS as a result of a missed or late payment or other types of delequencies for the same or any other service; services suspended do not have to be in direct relation to the delequent payment service. ATS is not responsible for losses resulting from a service suspension.

Privacy - We use your information for our own purposes of conducting business. We do not sell or share your information with third parties. All information such as account information, emails, or otherwise may be viewed by ATS at any time for any reason.

Collection - All invoices are NET 30 days unless otherwise stated. If payment is not received within 30 days of the invoice date, the invoice is considered past due. A reasonable attempt will be made to collect past due debts. If the attempt(s) are unsuccessful, court filings will begin on past due charges.
